QualConnect is software for qualitative recruitment agencies. It is operated by Software Symphony Pty. Ltd. (ABN 35 114 191 276) from Waverley, NSW, Australia.

If you browse this website or request a walkthrough, you are using the public site. Use it honestly. Do not scrape it, probe it, or fill the form with rubbish.

If you sign in to the desk, you are using the product under the agency's licence. The agency is responsible for who it invites and for what those people do.

If you fill in a recruit form or a screener, or receive a booking message, you are dealing with the agency named on that page or in that message. These terms do not make a contract between you and QualConnect for that research. Write to the agency if you have a question about the job.

We grant the licensed agency a non-exclusive right to use QualConnect for its own qualitative recruitment work, for the term we agree. The licence is for that agency. It is not a sale of the software, and it is not a right to resell the product or to run another house on the same tenant without asking us.

The licence is flat for the agency: hosting is included, and it is not charged per seat or per completed session. The fee, the start date, and any trial period are what we confirm in writing or on the invoice. Figures on the website, if shown, are indicative.

The agency may put its own name, logo and theme on the desk. That does not transfer the QualConnect software, and it does not make us the agency.

Panel records, jobs, screeners, bookings, messages, templates, imports and the files you upload belong to the agency. We host them so the desk can run. We do not use them to market QualConnect, and we do not show one agency another agency's panel.

You must have a right to hold the people you put on the panel and the answers you collect. You write the screener questions. You send the invitations and confirmations. You are the organisation that decides why that information is collected, and you are responsible for the privacy wording respondents see.

When the licence ends we will, on request, give the agency a reasonable export of what we hold for it, then delete or return the rest, unless the law says we must keep a copy.

Job email, SMS and eGifts go out on accounts the agency connects. Those providers bill the agency. Their cost is not included in the QualConnect licence. The agency is the sender — including under the Spam Act 2003 (Cth) — and is responsible for the wording and who it goes to. We store the keys encrypted and use them only to send what the desk asked us to send.

Walkthrough replies and invitations to join QualConnect go out as QualConnect.

Until we switch an agency to live delivery, outbound email and SMS are redirected to platform operators instead of the intended person, so we can check the product before real respondents are mailed. Live mode sends to the destination. Do not assume a saved key means live sending is on.

• Try to reach another agency's tenant, or anyone's records you were not invited to see.
• Send unlawful, deceptive or unsolicited messages through the desk.
• Upload personal information you do not have a right to hold.
• Probe, scrape or overload the service, or interfere with other customers.
• Copy, resell or white-label the product for a third party except as we have agreed in writing.

If you do, we can suspend the desk. We will say why, unless the law or a live incident says we must move first.

We run the product so the desk stays up. We do not promise uninterrupted access. We will repair faults and give notice of planned work where we can. Features marked as on the way are not part of the current licence.

We may change the product. If a change would take away a material part of the desk you licensed, we will talk to you first.

Licence fees are in Australian dollars and exclusive of GST unless the invoice says otherwise. They are due on the dates we agree. If a fee is overdue we may suspend the desk after notice.

Email, SMS, eGift and similar usage sit on the agency's own accounts and the agency's own bills.

Either of us can end the licence on the notice we agreed, or immediately if the other side materially breaches these terms and does not fix it in a reasonable time. We can also end it if the agency stops paying.

After it ends, the right to use the desk ends. Sign-in will stop. Records are handled as above.

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.

Where we are allowed to limit our liability, we limit it to resupplying the service or paying the cost of resupply, and in any case to the licence fees the agency paid us in the 12 months before the claim. We are not liable for an agency's own messages, incentives, research, or the people it puts on its panel.

The agency indemnifies us against claims that come from its content, its messages, its panel, or the accounts it connects to send mail, texts or eGifts, except to the extent we caused the claim.

We own QualConnect — the code, the design, the help and the training. The agency owns its records and the copy it writes. A public recruit page or screener sits on our host; the questions and the answers are the agency's. Help on the desk may use records already on that agency to answer a signed-in person.

These terms are governed by the law of New South Wales. The courts of New South Wales have jurisdiction.

If these terms change in a material way we will update this page and change the date at the top. For a licensed agency we will also tell the people we have on file for that house. Continued use after that is acceptance of the new terms, unless we have agreed something else in writing.
